Civil Rights

Unfortunately, there are still many individuals who have been the victims of bigotry, ignorance, and the abuse of power. Our civil rights work includes police misconduct, inmate rights, and other constitutional claims involving First, Fourth, Fifth, Eighth, and Fourteenth Amendment issues, including:

  • Violations of Due Process
  • Unreasonable search and seizure
  • Excessive Force (including police shootings with both firearms and less than lethal methods)
  • Malicious prosecution/wrongful arrest
  • Conditions of confinement
  • Failure to provide necessary medical care

Though this may be a wagon many attorneys are just now joining, we have been committed to an aggressive, critical and creative approach, which has resulted in several settlements on behalf of our clients. These cases are complex, often fraught, and difficult to win, however, we are committed to the belief that no one is above the law and everyone deserves the protections afforded to them under those same laws.

Business & Construction Disputes

WHO? Many different people can become involved in lawsuits or disputes with their employees, contractors, representatives, agents, distributors, vendors and customers.

WHAT? Business litigation and disputes can quickly develop for many reasons, including but not limited to:

  • Contract disputes/Breaches of contract
  • Partnership/LLC disputes
  • Shareholder disputes
  • Breaches of fiduciary duty
  • Payment disputes
  • Misappropriation of trade secrets, intellectual property and proprietary information

WHEN/WHERE? We know running a business is tough enough, let us do the heavy lifting here. Business disputes can be messy the longer the bad conduct goes on. Do not hesitate to reach out, even if you are not sure you have a case. As the saying goes, time is money.

HOW? In many cases, the high cost and time associated with business litigation cases discourages business owners from filing lawsuits for legitimate purposes. However, the reality is that most lawsuits and disputes are resolved through effective negotiation long before they reach trial. We take our clients’ goals and objectives seriously, and we will work to get the resolution you are looking for in the shortest possible time frame and in a cost-effective manner. Our experienced lawyers work to quickly assess the underlying contract(s) and the initial position of each party. We will then work to ascertain the damages associated with the dispute and begin constructive negotiations as soon as possible.

Appeals

If you’ve been convicted of a crime or lost your family court/civil case at trial, you may have grounds to turn it around on appeal. However, appeals in Kentucky are complicated, and not many attorneys handle them. They require a nuanced understanding of legal standards and technical details. You need a lawyer who can identify and articulate the strongest grounds for appeal in your case. We have proudly handled and assisted in appeals in state and federal courts. We are equipped to handle both criminal and civil appeals. As we are also experienced trial attorneys, we are uniquely positioned to develop key legal arguments for your appeal, undertake any legal research necessary, and be successful in oral arguments. Even if your case was originally handled by other attorneys, we’re here to take your case and move it in the right direction.
