Automobile Accidents
Kentucky car wreck law is complicated, and insurance companies are happy to prey on the uninformed. We, however, will strive to maximize our client's personal injury claims after a car wreck. The first steps though come from YOU and being aware of what to do if you are ever in an accident. This includes:

Make sure no one needs medical attention
The first priority after a car accident should be ensuring the health and safety of everyone involved. If you are not injured, check with the other drivers and/or passengers in the other cars, and confirm with them that they are not hurt.

Document what happened
Take some time to photograph the scene, the other drivers’ license plate(s) and anything about the vehicles involved that may help illustrate who was at fault. Take a photo of or write down the information from others’ driver’s licenses. Back these up to your computer when you get home and keep them in your records until everything is settled. You should also talk to witnesses and take down their name and contact information.

Get a police report
Reports can document both your and the other driver’s statements and any finding of fault. However, if you think the accident was your fault, do not say so to the officer. You should be provided with a report number that will allow you to retrieve a copy of this report within a few days.

Keep good records
Keep good records of any costs you might suffer as a result of the accident — medical bills, car repairs, rentals, replacement of damaged personal items, are required medical devices are all important losses -- Keeping good records of these expenses from the start will help you from having to find them later on.

Look for Your attorney
Don’t talk to the insurance companies about fault or settlement until you have consulted your attorney. Making a statement to the insurance company without counsel could ruin your case, causing blame for the accident to fall on you unfairly, or providing information that could be used against you later in a moment of confusion and distress.
Comparative fault state
The question of “Who is at fault?” in an auto accident it not always clear, but Kentucky recognizes this and requires use by the Courts of the “doctrine of Pure Comparative Fault.” This means that, in the event of an automobile accident, you may be able to recover damages, even if liability for the incident is in dispute. (Yes, even if the accident is partially your fault, you may be able to obtain compensation for your injuries). How much a person can recover is limited and proportional to how much liability they are determined to have for an incident. Ex. If a party is 40% at fault with $10,000 in treating their injuries, they can recover 60% ($4,900) of their damages.
